Resumen:	Con el presente trabajo se pretende el análisis normativo y jurisprudencial de la situación actual en la que encuentra el sistema de guarda y custodia compartido, derivado de las reformas legislativas propiciadas a partir de su inclusión en el Código Civil Español y el Libro Segundo del Código Civil de Cataluña. Con especial atención a la incidencia de la violencia de género en el ámbito familiar, como generadora de problemas prácticos en la adopción del régimen de guarda y custodia compartido. Abordando conjuntamente las discrepancias surgidas respecto a la relevancia y preferencia de este, en función del supuesto concreto y su condición, resguardado por una limitada regulación de la situación, seguida de un difuso conjunto normativo de reformas mediante las cuales se pretende la protección de las víctimas, concediendo esta condición también al menor. Al mismo tiempo que un análisis de la actitud jurisprudencial, esencial en el desarrollo y solución de las controversias prácticas, encauzado y perfilado por las relevantes actuaciones del Tribunal Supremo y del Tribunal Superior de Justicia de Cataluña, guiadas por la primacía otorgada al interés superior del menor y al mantenimiento del vínculo paternofilial de los progenitores para con sus hijos e hijas menores.
Resumen:	The present work aims at the normative and jurisprudential analysis of the current situation in which the system of shared custody and custody is found, derived from the legislative reforms promoted from its inclusion in the Spanish Civil Code and the Second Book of the Civil Code of Catalonia. With special attention to the incidence of gender violence in the family environment as a generator of practical problems in the adoption of the shared custody and custody regime, jointly addressing the discrepancies that have arisen regarding the relevance and preference of this depending on the specific case and their condition, protected by a limited regulation of the situation, followed by a diffuse set of normative reforms through which the protection of the victims is sought, granting this condition also to the minor. As well as the analysis of the jurisprudential attitude as essential in the development and solution of practical disputes, channeled and outlined by the relevant actions of the Supreme Court and the Superior Court of Justice of Catalonia, guided by the primacy granted to the best interests of the minor and to the maintenance of the parental bond of the parents with their minor sons and daughters.
