El Orestes de Eurípides invita a observar la fase intermedia entre el Orestes matricida y el suplicante de Apolo, durante la cual se despliegan los procedimientos preliminares al juicio público y el juicio mismo, que sanciona el homicidio con la pena capital por lapidación. Toda la acción está teñida por el oxímoron que la matiza desde el status qualitatis como un acto «justo» pero «impío». La calificación del crimen y el castigo insoslayable se constituyen así en el tema fundamental y dominante; afloran en él las paradojas de la jurisprudencia que nunca se fija de manera ineluctable en una de las partes antagonistas. A través de un . . t. µ. t . , llevado a cabo en el seno de una asamblea popular, el derecho revela sus constantes desplazamientos. |

The Oreste of Euripide invites to observe the intermediate phase between the matricidal Oreste and the supplicant of Apolo, during which the preliminary procedures of the trial and the trial itself -that sentences homicide by being stoned to death- are displayed. All this action is tinged with the oximoron that qualifies it from the status qualitatis as a «fair act» but «ruthless». The characterization of the crime and the unavoidable punishment become then the fundamental and prevailing subjet; there, the paradoxes of jurisprudence, which is never established in one of the antagonistic parties in an inescapable way, come to the surface. Through a . . t. µ. t . which took place in the heart of a popular meeting, the law reveals its constant movements. The sovereing decision of the people together as a court, suggest the idea, legally false, of the community implication in a trial about matricide. This decision is particulary suitable to produce a purifying effect, confirmed by the use of the stone in a punitive function, foreign to the polis institucional system. |
